Thanks for your interest in our company. We take data protection very seriously.

You can use our website without providing any personal data. If a data subject wants to use services of our enterprise via our website, processing of personal data could become necessary. If processing of personal data is necessary and if there is no legal basis for such processing, we will always obtain the consent of the data subject.

The processing of personal data (e.g. the name, address, e-mail address, or telephone number of a data subject) shall always be in line with the General Data Protection Regulation (GDPR), and in accordance with the country-specific data protection regulations applicable to us.

As the data controller, we have implemented numerous technical and organisational measures to ensure the most complete protection of personal data processed through our website. However, data transmissions via the Internet can always contain security vulnerabilities. Therefore, 100% protection cannot be guaranteed.   • "Data controller" shall mean the natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the data controller or the specific criteria for its designation may be provided for by Union or Member State law.
  • "Recipient" shall mean a natural or legal person, public authority, agency or other body to whom personal data are disclosed, whether or not it is a third party. However, public authorities which may receive personal data in the framework of a specific investigation mandate under Union or Member State law shall not be considered as recipients and the processing of such data by those authorities shall be carried out in accordance with the applicable data protection rules, depending on the purposes of the processing.
  • "Third party" shall mean any natural or legal person, public authority, agency or other body different from the data subject, the data controller, the data  processor and persons under the direct responsibility of the data controller or the data processor who are authorised to process personal data.
  • "Consent" means the consent given by the data subject in each case on a case-by-case basis, voluntarily, on an informed basis and by an unambiguous expression of his or her will in the form of a declaration or other unambiguous affirmative act by which the data subject indicates that he or she consents to the processing of personal data relating to him or her.

4.    Deletion and blocking of personal data

We process and store personal data of the data subject only for the period of time necessary to achieve the purpose of storage or if this is provided for by the applicable laws to which the data controller is subject.

If the storage purpose ceases to apply or if a legally prescribed storage period expires, the personal data will be routinely blocked or deleted in accordance with the statutory provisions.
 

5.    Collection and storage of personal data and the nature and purpose of their use

a)    By visiting the website

You can generally use our website without disclosing your identity. When you access our website, the browser used on your end device automatically sends information to our website server. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until automatic deletion:

  • IP address of the requesting computer
  • Date and time of access
  • Name and URL of the retrieved file
  • Website accessed from (referrer URL)
  • The browser used and, where applicable, the operating system of your computer, as well as the name of your access provider

The above data will be processed by us for the following purposes:

The legal basis for data processing is Art. 6 para. 1 p. 1 lit. f DSGVO. Our legitimate interest follows from the purposes for data collection listed above. In no case do we use the collected data for the purpose of drawing conclusions about your person..

b)    By using our Jobalert contact form

For questions of any kind, we offer you the possibility to contact us via an email address provided on our website. Furthermore, we offer the user the possibility of being notified by email via our Jobalert area as soon as a new job offer appears. If a user takes advantage of this option, the data entered in the input mask will be transmitted to us and stored. These data are: a valid email address and via drop down menu: Location(s) of the job, job category, working time /shift, so that we know who the enquiry is from and so that we can answer it. Further information can be provided voluntarily. It is up to you to decide whether you want to enter this data in the form. The following data is also stored at the time the message is sent: The user's IP address, date and time of registration.

Alternatively, it is possible to contact us via the e-mail address provided. In this case, the user's personal data transmitted with the e-mail will be stored.

In this context, the data will not be passed on to third parties. The data is used exclusively for processing the conversation.

Data processing for the purpose of contacting us is carried out in accordance with Art. 6 Para. 1 S. 1 lit. a DSGVO on the basis of your voluntarily given consent.

The personal data collected by us for the use of the contact form will be automatically deleted after completion of your request. You can unsubscribe from the newsletter at any time with just one click.

c)    When using our job offer / application

You can initialise an application directly via our job portal and - if desired - also upload relevant application data (e.g. for an open/advertised position); this does not require prior registration. Your personal data will be entered into an input mask and transmitted to us and stored. If you submit an application via our portal, we first collect the following data:

  • Salutation
  • First name, last name,
  • Street,
  • POSTCODE,
  • City,
  • Telephone / Mobile,
  • E-mail
  • How did you find us (via pull-down menu)

Further details can be entered voluntarily. You are free to decide whether you wish to enter this data in the form/upload. The following data is also stored at the time the message is sent: The user's IP address, date and time of registration.

Alternatively, it is possible to contact us via the e-mail address provided. In this case, the user's personal data transmitted with the e-mail will be stored.

In this context, the data will not be passed on to third parties. The data will be used exclusively for the processing of your application purposes.

Data processing for the purpose of contacting us is carried out in accordance with Art. 6 Para. 1 S. 1 lit. a DSGVO on the basis of your voluntarily given consent.

The collection of this data takes place,

  • to be able to identify you as our applicant;
  • to be able to process and handle your application;
  • to correspond with you;
  • to ensure the technical administration of our website;
  • to manage our applicant data.

As part of the application process, consent is obtained from you to process this data.

The personal data collected by us for the purpose of processing your application will be deleted when the purpose ceases to apply, or stored until the expiry of the legal obligation to retain data and then deleted, unless we are obliged to store the data for a longer period in accordance with Article 6 (1) sentence 1 lit. c DSGVO due to tax and commercial law retention and documentation obligations (from AGG, HGB, StGB or AO) or you have consented to storage beyond this in accordance with Article 6 (1) sentence 1 lit. a DSGVO.

6.    Further explanations on the legal basis of the processing

Art. 6 I lit. a DSGVO serves Prosegur as the legal basis for processing operations for which consent must be obtained for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is a party, the processing is based on Art. 6 I lit. b DSGVO. The same applies to processing operations which are necessary for the performance of pre-contractual measures, for example in the case of enquiries about our services and products. If Prosegur is subject to a legal obligation which requires the processing of personal data, the processing is based on Art. 6 I lit. c DSGVO. In rare cases, the processing of personal data might become necessary in order to protect the vital interests of the data subject or another natural person. In this case, the processing is based on Article 6 I lit. d of the GDPR. Furthermore, processing operations could be based on Art. 6 I lit. f DSGVO. Processing operations which are not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary for the protection of a legitimate interest of Prosegur or a third party, unless such interest is overridden by the interests, fundamental rights and freedoms of the data subject. Such processing operations are permitted to us in particular because they have been specifically mentioned by the European legislator (cf. recital 47 sentence 2 DSGVO).

7.    Consideration of  Legitimisation interests

If the processing of personal data is based on Article 6 I lit. f DSGVO, the legitimate interest of Prosegur is the implementation and fulfilment of our business activities for the benefit of our employees and shareholders.

8.    Dissemination of information

Your personal data will only be passed on to third parties by us to the service partners involved in the processing of the contract, such as the logistics company commissioned with shipping. In cases where your personal data is passed on to third parties, however, the scope of the data transferred is limited to the minimum necessary.

Your personal data will not be transferred to third parties for purposes other than those mentioned above.

We will also only share your personal data with third parties if:

  • You have given your express consent in accordance with Art. 6 para. 1 sentence 1 lit. A DSGVO,
  • The disclosure is necessary for the assertion, exercise or defence of legal claims pursuant to Art. 6 (1) sentence 1 lit. f DSGVO and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data,
  • In the event that there is a legal obligation to disclose your data pursuant to Art. 6 para. 1 sentence 1 lit. c DSGVO, as well as
  • This is legally permissible and necessary for the processing of contractual relationships with you according to Art. 6 para. 1 p. 1 lit. b DSGVO.

  

9.    Use of cookies

We use cookies on our website in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO. These are small files that are automatically created by your browser and stored on your end device (laptop, tablet, smartphone or similar) when you visit our website. Cookies do not cause any damage to your end device and do not contain any viruses, Trojans or other malware.

Information is stored in the cookie that arises in each case in connection with the specific terminal device used. However, this does not mean that we gain direct knowledge of your identity.

The provider of the linked website is solely liable for illegal, incorrect or incomplete content as well as for damages resulting from the use or non-use of the information. 11.    Analysis and monitoring tools

The tracking measures listed below and used by us are carried out on the basis of Art. 6 (1) sentence 1 lit. f DSGVO. With the tracking measures used, we would like to ensure a needs-based design and the ongoing optimisation of our website. On the other hand, we use the tracking measures to statistically record the use of our website and to evaluate it for the purpose of optimising our offer for you. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected from me, as well as the existence of automated decision-making, including profiling, and, if applicable, meaningful information about its details;
  • Demand the correction of inaccurate or incomplete personal data stored by us without delay in accordance with Art. 16 DSGVO;
  • Demand the deletion of your personal data stored by us in accordance with Art. 17 DSGVO, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the assertion, exercise or defence of legal claims;
  • To request the restriction of the processing of your personal data in accordance with Art. 18 DSGVO, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure and we no longer require the data, but you need it for the assertion, exercise or defence of legal claims, or you have objected to the processing in accordance with Art. 21 DSGVO;
  • In accordance with Art. 20 DSGVO to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request the transfer to another data controller without hindrance by us. In exercising this right, you also have the right to obtain that the personal data relating to you be transferred directly from us to another data controller, where this is technically feasible. If your personal data is processed on the basis of legitimate interests pursuant to Art. 6 (1) sentence 1 lit. f DSGVO, you have the right to object to the processing of your personal data pursuant to Art. 21 DSGVO, insofar as there are grounds for doing so that arise from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right of objection, which is implemented by us without specifying a particular situation.

We use the widespread SSL procedure (Secure Socket Layer) in connection with the highest encryption level supported by your browser when visiting the website. As a rule, this is 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is transmitted in encrypted form by the closed display of the key or lock symbol in the status bar of your browser.

We also use appropriate technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorised access by third parties.
